Although our Website may be accessible worldwide, we make no representations that  materials thereon are lawful, appropriate, or available for use in locations outside the  US, and accessing our Website from territories where its content is illegal is  prohibited. Those who choose to access our Website from other locations do so on  their own initiative and are responsible for compliance with all applicable local laws.  You acknowledge that if you access our Website from outside the US, the laws on  advertising, data privacy, content restrictions, and other pertinent topics may be  different in your country (or location) from those in the US under which our Website  is compliant.

AgencyOne does not knowingly collect, use, or  disclose personal information from children under the age of 16 without prior parental  or guardian consent, except as permitted by the Children’s Online Privacy Protection

If you are a parent or guardian and believe we have inadvertently  collected your child’s information in a manner not permitted by COPPA, please send  us an email at marketing@agencyone.net and we will delete the information. If your  use of our Website is prohibited or restricted in any way by the laws, regulations or  other government requirements of the jurisdiction in which you live or reside, or if,  for any reason and at any time you do not agree with the terms of this Privacy Policy,  please discontinue using our Website immediately. By accessing our Website you  certify you are at least 18 years of age or have a parent’s or guardian’s permission to  access our Website.

3.1.2. Information that is about you but does not identify you such as online habits,  buying history, preferences, etc. 

3.1.3. Technical information about your device and connection such as: 

3.1.3.1. Preferences: Time zone, language, zoom size, etc. 

3.1.3.2. Identifiers: IP address; mobile device SIM/identifier, etc. 

3.1.3.3. Type: type of device, operating system or platform (Mac,  

Windows), browser information (type, version), etc. 

3.1.3.4. Connection: Internet provider or mobile carrier name, connection  speed and connection type; internet service provider, etc. 

3.1.3.5. External pages: URL of the last and next page visited, etc. 

3.1.3.6. Use of the Website: Data, pages viewed, time spent on a page,  click through, clickstream data, queries made, search results  

selected, history, comments made, etc. 

3.1.3.7. Location: Geographic and network location, etc. 

3.2. How We Collect. We collect this information: 

3.2.1. Directly from you when you type or transmit it to us, including:

3.2.1.1. Information that you provide by filling in forms on the Website.  This includes information provided in the process of carrying out a  

transaction through the Website. 

3.2.1.2. Information requested by us when you report a problem with the  Website. 

3.2.1.3. Records and copies of your correspondence (including email  addresses), if you contact us.

3.4.6. We do not collect personal information automatically, but we may tie this  information to personal information about you that we collect from other

4.4. No Liability for Acts of Third Parties. We will exercise all reasonable efforts to safeguard the confidentiality of customer personal information. However, transmissions protected by industry standard security technology and implemented by human beings cannot be made absolutely secure. Consequently, we shall not be liable for unauthorized disclosure of personal information due to no fault of our own including, but not limited to, errors in transmission and unauthorized acts of our staff and/or third parties. 

4.5. WE HEREBY DISCLAIM ALL RESPONSIBILITY AND LIABILITIES FOR THE  SECURITY AND PRIVACY PRACTICES OF SUCH OTHER SITES. You are  responsible for checking and understanding the policies others web sites to  understand their policies.

  1. Opt In, Opt Out and Choices About How We Use and Disclose Your Information. 7.1. OPT IN DEFAULT: EXCEPT AS SET FORTH OTHERWISE HEREIN, YOU  CONSENT TO ALL USES OF YOUR INFORMATION SET FORTH HEREIN. 7.2. Opt Out Options: We strive to provide you with choices regarding the information  you provide to us. We have created mechanisms to provide you with the following  control over your information: 

7.2.1. Tracking Technologies and Advertising. You can set your browser to refuse  all or some browser cookies, or to alert you when cookies are being sent. If  you disable or refuse cookies, please note that some parts of this site may then  be inaccessible or not function properly. 

7.2.2. Email Communications From the Company. If we have sent you an email as  described herein, you can opt-out of future emails by using the unsubscribe  link listed in each email in which it is provided, or by sending us an email  with “Use of Personal Information” in the heading, at  

marketing@agencyone.net stating your request. Please include your full name,  mailing address, and email address with your request. This opt-out does not  apply to emails from us communicating changes to this Privacy Policy. 

7.2.3. Targeted Advertising. If you do not want us to use information that we collect  or that you provide to us to deliver advertisements according to our  

advertisers’ target-audience preferences, you can opt-out by sending us an  email with “Use of Personal Information” in the heading, at  

marketing@agencyone.net stating your request. Please include your full  

name, mailing address, and email address with your request. For this opt-out  to function, you must have your browser set to accept browser cookies. Please  note this does not opt you out of being served advertising, and generic  

advertising may still appear on the Website. 

7.3. We do not control third parties’ collection or use of your information to serve  interest-based advertising. However these third parties may provide you with ways to  choose not to have your information collected or used in this way. You can opt-out of  receiving targeted ads from members of the Network Advertising Initiative (“NAI”)  on the NAI’s website. 

  1. Your Rights and How to Exercise Them. 

8.1. You have the right to: 

8.1.1. Request a copy of the specific Personal Information that we have collected about  you in the previous 12 months; 

8.1.2. Require (with certain exceptions) that we delete your Personal Information;  8.1.3. Right to correct any inaccuracies in your Personal Information; 

8.1.4. Right to data portability (i.e. easy, portable access to all personal data held by us);

8.1.5. The right to opt-out of the processing of personal data for targeted advertising  purposes; 

8.1.6. The right to opt-out of the sale of personal data; 

8.1.7. The right to opt-out of profiling based upon personal data; and 

8.1.8. Not be discriminated against for exercising these rights. 

8.1.9. To make a request related to these rights, or if you have an issue or complaint  about how we handle your Personal Information, please send us an email with  “Privacy Rights” in the heading, at marketing@agencyone.net . Please include your  full name, mailing address, and email address with your request. 

8.1.9.1. California Residents. If you live in California, California  

Civil Code Section 1798.83 permits California resident users  

of a website to request and obtain, once a year and free of  

charge, certain information regarding our disclosure, if any, of  

certain categories of Personal Information to third parties for  

their own direct marketing purposes in the preceding calendar

mailing address and email address with your request. 

8.1.10. We are unable to delete User Contributions and individual pieces of your personal  information except by also deleting your Login. We reserve the right to deny your request to change information if we believe the change would violate any law or  legal requirement or cause the information to be incorrect. If you delete your User  Contributions from the Website, copies of your User Contributions may remain  viewable in cached and archived pages. 

8.1.11. We will endeavor to comply with any such request made under Section 8 within  45 days. 

  1. Data Security and Storage. 

9.1. We have implemented measures designed to secure your personal information from  accidental loss and from unauthorized access, use, alteration, and disclosure. All  information you provide to us is stored on secure servers behind firewalls. Any  payment transactions and all information provided through forms on the Website will  be encrypted using SSL technology. 

9.2. The safety and security of your information also depends on you. Where we have  given you (or where you have chosen) a password as part of a login for access to  certain parts of the Website, you are responsible for keeping this password  confidential and not to share your password with anyone.

If you have  provided us with your email address in the process of ordering the Service, we may  also communicate with you by email to inform you of any changes, and you are  responsible for ensuring we have an up-to-date active and deliverable email address  for you.
